Thank you for visiting payspan.com, a website operated by PaySpan, Inc. (herein "PaySpan," "we" or "us").  Your privacy is important to us, so we provide this Privacy Policy ("Policy") explaining PaySpan's online information practices and the choices you can make about the way certain information is collected and used at this website and other websites and applications where this Policy is posted, including any online and mobile sites, owned, operated or offered by or on behalf of PaySpan or its affiliates (each a "Site" and collectively the "Sites").  Please contact us as indicated in the "Contact Us" section below if you have any questions or would like additional information. We may update this Policy from time to time, so please check this Policy periodically for changes.
What Information is Collected?
We may collect personally identifiable information and other types of information when you use our Sites or when you communicate with us through our Sites. For purposes of this Policy, "personally identifiable information" means private information collected by us through the Sites that may be used to uniquely identify an individual.  Personally identifiable information might include the following alone or in some combination: individual name, date of birth, mailing address, telephone number, email addresses, bank account information, FEDERAL TAX ID NUMBER (TIN), social security number, other government-issued identification number and telephone numbers.  Personally identifiable information does not include any public information about an individual that is available through federal, state or local public records or business information collected through the Sites.  It also does not include any information that, by itself, does not uniquely identify an individual, such as raw data aggregated across many individuals, Site usage, measurement, analytics, and other data and information available to us directly or from one of our service providers in aggregated, de-identified or other non-personalized forms or formats.
On certain Sites, only persons who register and provide us with the requested information will be able to purchase, license and/or apply for products, programs and services available by or through the Site and/or otherwise participate in the Site activities and offerings ("Products").  In connection with some of these Product offerings, we collect business information. We also collect data entries made by users of our Sites and data files submitted by users in connection with certain Product offerings on our Site, some of which may contain personally identifiable information about third persons.  In registering for these Sites and Products, users may be required to choose a user name and/or password. You acknowledge and agree that we may use and rely on this information to identify you.
We, and/or our third party providers, advertising networks and platforms, agencies and marketing partners (collectively, "our service providers"), collect information that is anonymous, de-identified or otherwise not intended to personally identify you when you visit or use our Sites.  Examples of such information that may be collected include network or Internet protocol address ("IP address"), browser type, the domain name of your Internet service provider, mobile network, device identifies, advertising identifiers, Site usage information, including sites visited before and after the Site, general location information, measurement, trends, patterns and other data and information available to us and/or our service providers in aggregated, anonymous or other non-personalized forms or formats through your use of our Sites.  When you visit a Site, we may view the IP address (which may include the city, domain address and service provider) of the device you use to connect to the Internet. We use this information to determine the general physical location of the device, understand the general location of visitors to this Site and verify eligibility to participate in certain features and offerings of the Site.
If you are accessing a PaySpan Site from a mobile device or through a mobile application, you may be asked to share your geo-location information with us so we can customize your experience on our Sites.  If you agree to such collection, you will be able to turn off such data collection at any time by assessing the privacy settings of your mobile device and/or through the settings in the applicable mobile application.
We will update your information as that information is processed through a Site and/or new information is made available to us in an effort to keep your information current, accurate and complete, or we will inform you if we are unable to process any requested update and why, consistent with this Policy.
Our Use of Your Information
Unless we say otherwise when collecting such information, we will use any personally identifiable information we collect through the Sites in accordance with the terms of this Policy.  We may use such information to fulfill your requests for Products, to communicate with you and to operate and administer the applicable Sites and Products.  We may also use your personally identifiable information (i) to offer you products, programs or services from us, our affiliates and/or our marketing partners that we believe may be of interest to you, (ii) to target, customize and personalize content, Products and advertisements to enhance their relevance to you, (iii) to enforce the legal terms that govern your use of our Sites and Products, and/or (iv) for the purposes for which you provided the information as may be stated at the point of collection.  From time to time, we may combine information we collect through our Sites with information we receive from other sources.  We may also aggregate personally identifiable information and other information about you with information about our other users.  You agree and consent to such use and agree that we will retain complete ownership and control over any aggregate and non-personally identifiable information that we compile or acquire.
Sometimes we hire other companies to provide products and services to you on our behalf, such as processing transactions, hosting websites and/or content for our Sites, conducting research and surveys and providing customer service.  We may share some of your personally identifiable information with these companies to enable them to provide such products and services on our behalf.  These companies are prohibited from using your personally identifiable information for any other purpose and are required to maintain its confidentiality.
We, our affiliates and our service providers may use the non-personally identifiable information that is collected to improve the design and content of our Sites, to deliver more relevant content, marketing messages and advertisements, to enable us to customize or personalize your experience with our Sites, to perform any and all analytics, to engage in any activities not prohibited by law and for the additional uses discussed in this Policy.  For clarity, we and our service providers may freely collect, use, maintain, disclose and share non-personally identifiable information to the fullest extent permitted by law, including when you are no longer a customer of PaySpan for any reason.
Further, we reserve all rights necessary to use and disclose your personally identifiable information as required and/or permitted pursuant to all laws, rules and regulations applicable to us and our Products.  If you are no longer a customer of PaySpan for any reason, we may continue to maintain and use your personally identifiable information for all reasonable business purposes as determined by us, consistent with applicable law and the terms of this Policy.
Information Sharing and Disclosure
We may share your personally identifiable information with our affiliates for their use in compliance with the Policy.  We will not sell, license, transmit or disclose personally identifiable information collected through our Sites outside of our organization and our affiliates unless (1) you expressly authorize us to do so; (2) it is necessary to allow our service providers or agents to provide Products for us or on our behalf; (3) it is necessary to allow our vendors to provide you third party products owned or controlled by them through the Services, to provide services for such products for us or on our behalf as they relate to the Products; (4) it is necessary in order to provide our Products to you, including in connection with the review, processing and consideration of any application for Products submitted by you, including purchaser verification, background checks, credit checks, authentication, geolocation and authorization for any orders (and contacting you when necessary); (5) it is disclosed to entities that perform marketing services on our behalf or to other entities with whom we have joint marketing agreements; (6) it is necessary in connection with other transactional and/or relationship purposes, including performance of any compliance obligations required or permitted by contract or law in connection therewith; (7)  it is response to legal process, such as a court order or subpoena or law enforcement agency's request or where we believe it is necessary to investigate,, prevent or take action regarding suspected illegal activities; or (8) otherwise as we are required or permitted by law or consistent with legal requirements or this Policy.
If you do not agree to Our Use of Your Information and Information Sharing above, we cannot do business with you or accept purchases of or applications for Products from you through the Sites. Your continued use of the Sites, registration for any Site, application for any Product available through a Site or other offerings, or purchase of any Products sold through a Site constitutes your acceptance of this Policy and your consent to the use of this information in accordance with the Policy. Information collected by us through the Site is considered a corporate asset and subject to transfer, sale and assignment to any successor-in-interest in the event of a corporate reorganization, merger or sale.

We appreciate your questions and comments about us and Products available through our Services and welcome your email messages at info@payspan.com.  We will share your messages with those within our organization and to applicable third-party providers who we believe are most capable of addressing your questions and comments. We may archive your message for a certain period of time or discard it once it is no longer needed.
Your Rights
You have the right to ask in writing not to receive commercial electronic email messages from us for which the primary purpose is the commercial advertisement or promotion of a commercial product or service. You will also have the opportunity to make this request at a later time in connection with your receipt of a commercial electronic message from us the primary purpose of which is the commercial advertisement or promotion of a commercial product or service by clicking on the appropriate "unsubscribe" button included with the message.  You may be given a choice to opt-out of certain types of commercial messages or all types of such commercial messages from us.  Once properly notified by you, we will take steps to stop using your information in this way consistent with applicable legal requirements. Please allow us a reasonable period of time in order to satisfy your request.  Please note that this preference change will not impact our ability to communicate with you about our Sites, relationship or any transactions between us.  Such transactional or relationship messages may include status updates, reminders, confirmations and other messages to you related to your purchase of products and services or use of the features and services on our Sites.
You have the right to ask in writing that we modify your personally identifiable information to correct and/or update the information, as set forth in this Policy.  We note that without use of certain of your information, we may not be able to provide you the Products or the same quality of Products you request. If you request removal of certain information from your account, then we will only retain copies of such information as necessary for us to comply with governmental orders, resolve disputes, troubleshoot problems, enforce any agreement you have entered into with us and as otherwise reasonably necessary for our business purposes, including compliance with all laws, rules and regulations applicable to us and our Products. Use of "Cookies" and other Technology Tools
A site may use "cookies" and similar technology to store and sometimes track information about you.  A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive.  Cookies allow us and our service providers to identify your computer and enable us to access your account as a convenience, and allow us to gather usage information, research visiting patterns, and help improve, customize and target content, offerings and advertisements on our Sites based on user interests.  We may also use cookies to save your password in password-protected areas and enable the use of shopping carts for Products on our Sites.  Our service providers may view, edit or set their own cookies.  Most browsers will allow you to change your preferences and configurations to refuse cookies. From time to time, we may incorporate the Adobe Flash Player in one of more of our Sites to allow quick development of dynamic content.  Flash employs use of locally stored objects known as Flash cookies to remember settings, preferences and usage similar to browser cookies, however, Flash cookies are not managed through your web browser.  Rather they must be accessed for configuration changes directly from Adobe's website.
Certain pages on our Sites may contain "web beacons" (also known as Internet tags, pixel tags, clear .gifs and similar technology) set by us and/or our service providers for third parties. Children
The Sites are not intended or authorized for, or designed to attract, use by any person under the age of 18. We recognize that areas of the Sites are generally available for viewing by visitors to the Site; however, areas of the Site that require registration and the submission of personal information are intended solely for persons over the age of 18. Accordingly, we do not knowingly collect information from or about children or provide services to children on this Site.
